Welcome to ArtFlux Gallery ("we," "us," or "our"). By accessing www.artfluxgallery.com (the "Site"), you agree to these Terms of Service ("Terms"). If you disagree, please refrain from using the Site.

Definitions

  • “Custom Artwork”: Handmade paintings created based on your specifications.
  • “Services”: Commissioning art, order processing, and related features.
  • “User”: Anyone using the Site or placing orders.

User Responsibilities

  • Account Integrity: Keep login credentials secure. You’re responsible for all account activity.

  • Prohibited Actions:

    • Illegal activities, fraud, or copyright infringement.

    • Uploading harmful files (e.g., viruses) or misrepresenting your identity.

Custom Orders

    • Process: Submit reference photos, style preferences, and approve a digital mockup before production.

    • Payment:

      • 30% non-refundable deposit to start work.

      • Final payment due after mockup approval.

    • Refunds:

      • Custom artwork is non-returnable unless damaged or materially deviates from the approved mockup.

      • Refund requests require proof within 48 hours of delivery.

Intellectual Property

      • Your Content: You own uploaded photos but grant us a license to create your artwork.

      • Artwork Rights:

        • Upon full payment, you own the physical piece.

        • Artists may display the work in portfolios unless you request anonymity (noted at checkout).

      • Copyright Claims: Report violations to [legal@artfluxgallery.com].

Disclaimers

  • “As Is” Service: We don’t guarantee uninterrupted or error-free access to the Site.

  • Liability Limit: We’re not liable for indirect damages (e.g., lost profits) from Site use.

Termination

We may suspend accounts for violations. You may terminate by discontinuing Site use.

Third-Party Services

  • Payments: Processed via PayPal/Stripe (subject to their terms).

  • Shipping: Delays/losses post-handoff are not our responsibility.

Dispute Resolution
